You are renovating. You want a skip outside your door for the rubble. Required: The pavement, parking spaces and road are public space. You must get the municipality's permission first. The right way: Apply for a permit before work starts. Sort waste by type. Skip without permit: Municipal tax: Can be increased; Also: Administrative fine (GAS); The skip: Removed at your cost.

What is not allowed, what is required?

  • To put a skip or scaffolding on the pavement, a parking space or the road, get permission from the municipality (vergunning inname openbaar domein / autorisation d'occupation du domaine public). Apply before you start the work.
  • Most municipalities charge a daily tax or fee for this. For example, in Watermael-Boitsfort the tax doubles if you do not apply in advance.
  • The permit usually comes with conditions. For example, under Ghent's general permit conditions, the permit holder pays for any damage to public property caused by the skip. You often have to put up the necessary traffic signs yourself; ask your municipality.
  • Flanders: construction and demolition waste must be sorted by type. Take small amounts to the municipal recycling centre and hand large amounts over to a registered private waste collector. Keep asbestos waste separate.
  • In Flanders and Brussels, burning waste in the open air is forbidden, including garden waste. In Wallonia, there is an exception for dry garden waste, subject to a minimum distance. Dumping rubble in the countryside or in someone else's skip is fly-tipping.

Penalty and indirect consequences

Legal basis:RGP Bruxelles, art. 4 §2-3 + Loi SAC 24.6.2013

Court / prison
A prison sentence is unlikely; for large-scale fly-tipping, the public prosecutor can bring proceedings.

Legal basis:Stad Gent – Retributiereglement sluikstort

What really matters: the indirect consequences

What do these terms mean?

GAS fine
An administrative fine imposed by the municipality itself. It is not a criminal sentence. The maximum is €500 for adults and €175 for minors. You can appeal within 1 month to the police court (the youth court for minors).

Why does this rule exist?

The pavement is there for pedestrians, especially children and wheelchair users. The permit system makes sure the skip is placed safely and that traffic is warned. Sorting the waste also makes it possible to recycle construction waste.
