You've bought a new speed pedelec: assistance up to 45 km/h. You're about to ride off with no helmet and no plate. Required: A speed pedelec counts as a moped. You need to be at least 16, with an AM or B licence, a helmet, registration and an SP plate. The right way: Wear a helmet and fit the SP plate. Where the limit is over 50 km/h, use the cycle path; never ride on the pavement. Consequences (1st-degree offence): No helmet, wrong place: 64 € + 10,67 €; At the police court: 100 € – 2.500 €; No licence, unregistered: Court sets the amount.

What is not allowed, what is required?

  • An electric bicycle whose pedal assistance goes up to 45 km/h is a speed pedelec. The rider must be at least 16 years old and hold an AM (moped) or B (car) licence.
  • Register the vehicle with the Vehicle Registration Service (DIV) and fit a number plate starting with SP. To register it, you need a certificate of conformity (gelijkvormigheidsattest / certificat de conformité).
  • A helmet is compulsory. You can wear a moped helmet or a special bicycle helmet (EN 1078) that also protects your temples and the back of your head.
  • If the bike can also move without pedalling, moped liability insurance (BA-verzekering bromfiets) is compulsory. If it only has pedal assistance, family liability insurance (familiale verzekering / assurance familiale) is enough. Insurers do not always agree on this, so ask in writing whether your policy covers the speed pedelec.
  • Where the speed limit is 50 km/h or less, you can choose between the cycle path and the road. Where the limit is above 50 km/h and there is a cycle path, you must use it. Riding on the pavement is forbidden.

Penalty and indirect consequences

Fine / payment
Breaking the traffic rules, such as riding without a helmet or in the wrong place, is a 1st-degree offence: on-the-spot fine 64 € (+10,67 € administrative costs). Riding without a licence, registration or the required insurance is a separate and more serious offence; the court decides the amount.

What really matters: the indirect consequences

  • Without the required insurance, you may have to pay for any damage you cause in an accident yourself

    Legal basis:BW Boek 6, art. 6.5

  • After an accident, stay at the scene and record what happened together with the other party. If you cannot agree, wait for the police. It is best to use the accident report form (aanrijdingsformulier / constat amiable) for this.

    Legal basis:Verkeersreglement (KB 1.12.1975), art. 52.2 (Justel)

  • If you fall without a helmet, the risk of a serious head injury is high

What do these terms mean?

On-the-spot payment
A fixed amount offered by the police. If you pay, the case is closed and does not go to court. If not, the prosecutor takes over; the amount can rise and the case can go to court.
Police court
The court for traffic offences and appeals against GAS fines. Despite the name, it is not part of the police; an independent judge decides.

Why does this rule exist?

A speed pedelec is much faster than an ordinary bicycle. A crash at 45 km/h has serious consequences for the rider and for pedestrians. Registration, a number plate and a licence make sure that riders know the rules and that the vehicle can be identified.
