I received a speed camera fine at home, but I was not driving: what should I do?

In short

You must identify the actual driver within 15 days. If you do not, the law presumes that you committed the offence. Showing that you were not the driver but not identifying the driver is also a level 2 crime; if the vehicle is registered to a company, failing to identify the driver is a level 1 crime.

Video transcript

A letter from a speed camera arrives at home. But that day, your brother was driving your car. Required: If the driver wasn't stopped, the law presumes the plate holder committed the offence. Report the real driver within 15 days. The right way: Fill in the form in the letter and name the real driver in time. The information you give must be true. Consequences: If you don't report: Offence counts as yours; Company doesn't report: 1.600 € – 32.000 €; Speeding fine amount: Based on km/h over.

What is not allowed, what is required?

  • If the driver was not stopped at the scene, the law presumes that the registered keeper (houder van de kentekenplaat / titulaire de la plaque) committed the offence.
  • If you were not driving, you can prove this by any means. In that case, you must give the identity of the actual driver within 15 days. The deadline and the address are in the letter.
  • If the vehicle was stolen, or in the event of fraud (e.g. a false number plate) or force majeure (overmacht / force majeure), you do not have to identify the driver, but you must prove this.
  • If the vehicle is registered to a company, the company or its representative must identify the driver within 15 days of the date the request was sent.
  • For the offences listed in the law, a reading from a speed camera (flitspaal) or an average speed check (trajectcontrole / contrôle de trajet) is considered valid unless proven otherwise. If you want to contest it, return the form in the letter before the deadline.

Penalty and indirect consequences

PENALTY NOTICE
Fine / payment
The amount depends on the offence; for speeding, it depends on how many km/h you were over the limit (see the card on speed limits). If a company does not identify the driver, this is a level 1 crime: the law sets a fine of 1.600 € – 32.000 €.

Legal basis:Wegverkeerswet 16.3.1968, art. 29ter §1 (Justel)

Court / prison
No prison sentence for your own offence. But if you show that you were not the driver and do not identify the actual driver, this is a level 2 crime: the law sets a fine of 400 € – 32.000 € and a prison sentence is also possible. If you do nothing, you are presumed to have committed the offence.

What really matters: the indirect consequences

What do these terms mean?

On-the-spot payment
A fixed amount offered by the police. If you pay, the case is closed and does not go to court. If not, the prosecutor takes over; the amount can rise and the case can go to court.
Police court
The court for traffic offences and appeals against GAS fines. Despite the name, it is not part of the police; an independent judge decides.

Why does this rule exist?

A camera records the offence but does not always show the driver's face. This rule stops the registered keeper from shifting responsibility so that nobody is penalised. When the actual driver is identified, the penalty goes to the right person.
