Can my dog be off the lead in the street? Can I be fined for barking or dog mess?
In short
In most municipalities, dogs must be kept on a lead in public spaces and you must pick up after them. Constant barking can also count as noise nuisance. The rules are set by the municipality.
Video transcript
You are walking your dog in the street. The lead is still at home. Required: In most municipalities dogs must be on a lead and their mess picked up. The municipality sets the rules. The right way: Use a short lead and always carry bags. Constant barking can also count as noise. Municipal fine (gas): No lead, mess left: max. 500 €; If the dog does damage: The owner is liable; Constant barking: Possible noise fine.
What is not allowed, what is required?
- The rules on leads, dog mess and barking are set in each municipality's police regulation (politiereglement / règlement général de police).
- Example – Brussels (19 municipalities): in public spaces, animals must be kept on a short lead. You must pick up the mess and always carry a bag.
- Example – Antwerp: dogs must always be on a lead no longer than 1,50 m. You must pick up the mess even in dog areas.
- Constant, loud barking can count as noise nuisance between neighbours. The Brussels regulation also treats animal noise as noise nuisance.
- Do not leave the bag next to a full bin; that counts as fly-tipping. Take the bag home.
Penalty and indirect consequences
- Fine / payment
- Municipal administrative fine (GAS-boete / amende SAC): the legal maximum for adults is 500 €; the municipality sets the amount (Antwerp: up to 500 €)
Legal basis:Stad Antwerpen – Regels voor honden op openbaar domein
What really matters: the indirect consequences
- The person looking after the dog (usually the owner) is liable for any damage it causes, even if they are not at fault.
Legal basis:BW Boek 6, art. 6.17
- If the barking is constant, your neighbour can take the matter to the justice of the peace
Legal basis:Ger.W. art. 591, 2°ter
- An aggressive dog must wear a muzzle in public spaces (for example, in Brussels)
Legal basis:RGP Bruxelles, art. 112, 3°
What do these terms mean?
- GAS fine
- An administrative fine imposed by the municipality itself. It is not a criminal sentence. The maximum is €500 for adults and €175 for minors. You can appeal within 1 month to the police court (the youth court for minors).
- Justice of the peace
- The local court in every canton for everyday disputes such as neighbour conflicts, rent and small debts. It first tries to reconcile the parties.
Why does this rule exist?
A lead protects children, older people, cyclists and other animals. Picking up dog mess keeps pavements and parks clean and hygienic. The barking rule protects neighbours' peace and quiet.
