Video transcript
A lovely Sunday. You want to light a barbecue in the park. It depends: It depends on the municipality and the park. In many parks barbecues are only allowed in marked areas. The right way: Use the marked barbecue area. Do not leave charcoal or rubbish on the ground. Municipal fine (gas): Adults: max. 500 €; Minors: max. 175 €; Charcoal, rubbish left: Plus cleaning costs.
What is not allowed, what is required?
- The municipal police regulation decides in which parks and in which areas you may have a barbecue.
- If there is no marked barbecue area, or a sign says it is forbidden, do not light a barbecue.
- You may not leave charcoal, ashes or rubbish behind; do not throw hot charcoal on the grass or into a bin.
- Smoke and smells from a barbecue at home, in the garden or on the balcony must not constantly disturb the neighbours either.
- Check the rules of the park you are going to on the municipality's website or on the sign at the park entrance.
Penalty and indirect consequences
- Fine / payment
- Municipal administrative fine (GAS-boete / amende SAC): the legal maximum is 500 € for adults (each municipality sets its own amount) and 175 € for minors (the minimum age is 14 or 16, depending on the municipality)
Legal basis:BeSafe – FAQ GASRèglement général de police Bruxelles 2026, art. 2 §1-§2
What really matters: the indirect consequences
- For charcoal and rubbish left on the ground, you may also get a fine for illegal dumping and have to pay cleaning costs
Legal basis:Règlement général de police Bruxelles 2026, art. 4 §3
- If you cause a fire or damage a tree, you may have to pay compensation
Legal basis:BW Boek 6, art. 6.5
- If smoke from a barbecue at home is a constant problem, the neighbour can go to the justice of the peace (art. 3.101)
Legal basis:Kamer DOC 55 0173/010 (BW Boek 3), art. 3.101 + Ger.W. art. 591, 2°ter
What do these terms mean?
- GAS fine
- An administrative fine imposed by the municipality itself. It is not a criminal sentence. The maximum is €500 for adults and €175 for minors. You can appeal within 1 month to the police court (the youth court for minors).
- Justice of the peace
- The local court in every canton for everyday disputes such as neighbour conflicts, rent and small debts. It first tries to reconcile the parties.
Why does this rule exist?
A barbecue is a fire risk and can damage grass and trees; smoke and smells bother other park users. Parks belong to everyone, and the rules make sure everyone can enjoy them.
