I am on a main road. Do I have to give way to a car coming out of a small street on my right?

In short

Yes, most of the time. If there are no signs or traffic lights, you must give way to every vehicle coming from the right, even from a small side street. Not giving way is a 2nd-degree offence.

Video transcript

You are on a wide road. A car comes out of a small street on your right. Required: With no sign or traffic light, you give way to traffic from the right. A wider road makes no difference. The right way: Slow down and let the car from the right go first. Then drive on. Fine notice (2nd-degree offence): Immediate payment: 128 € + 10,67 € costs; At court: 200 € – 2.500 €; Driving ban: 8 days – 5 years possible.

What is not allowed, what is required?

  • If a junction has no priority sign or traffic light, priority to the right (voorrang van rechts / priorité de droite) applies.
  • Being on a wider or busier road does not give you priority.
  • Signs (yellow diamond, "give way" triangle, STOP), traffic lights and the police change who has priority. A vehicle coming out of a dirt track or a path does not have priority, even if it comes from the right.
  • The driver coming from the right must also be careful, but in an accident the driver who did not give way is usually found at fault.
